Would Hong Kong Setup Work Here?

13 posts in this topic

I went to hong kong last year and went toa place in Mong Kok that operated as a brothel even though laws in Uk and Hk are similar. It got around legislation by having a karaoke bar setup with a separate hotel in the same building but operating as a separate business for the action.

You walk into the high rise building and walk up to the Karaoke floor the bsusiness provides rooms with private rooms with karaoke equipment in. In the room the mamasan brings in girls 1 or 2 at a time till you find someone you want to accompany you and sing. At this point you leave with the girl and pay for the hire of the room you just used hk $300, The girl not being bound by the club can leave with you and go to the hotel upstairs with you where you pay for the hire of a bedroom with shower etc for a further hk $200. The girl spends the hour with you that you paid for the room and then leaves. You are free to leave too.

So would separating the place you meet the girl and the place the business is done get around the law?

I apologise if the discription doesnt make too much sense but its late :P

Hi sounds interesting, am a bit confused what was the total cost of the punt $500? or did that not include the fee?

I reckon some smart arse in the uk would prove it was effectively the same establishment.

Reminds me of something I read about 'Noodle bars' in Japan. Basically you buy a rather expensive bowl of noodles in a private room while the waitress makes sure your comfy ;)

Unfortunately i have no personal experience of such a thing despite spending a few years in tokyo.

Hong Kong law is largely based on British law and so you would think there would be some scope for that. There is a building near Causeway Bay that has 21 floors of WGs but they are all in individual bedrooms. So technically, they are all working out of separate apartments and so it can't be classed as a brothel. Don't think we have anything like this in the UK.

And yes, I will be PMing you!

These places don't usually have an entrance fee. $500 is about the going rate in HK. It goes up to about $800 for the 'hotel reservation' girls.

21 floors of WGs? Blimey! Imagine the queues for the lifts! ;)

Indeed. There are only 2 lifts as well. One for odd floors, one for evens. First time I went there I was wondering if i was in the right place as it just looks like any typical normal residential building in Hong Kong. Then I sussed as I got in the lift: it was packed with nothing but me and shifty looking Chinese blokes looking at the floor and not making eye contact. I thought, yep, this must be the right place!

OP was referring to 'hk$' (HK Dollars). The current exchange rate is £1 = HK$ 12.05. Unless he was confused, too.

I reckon some smart arse in the uk would prove it was effectively the same establishment.

I don't think that the CPS would need to be that smart to prove that the premises constitute a brothel.

Durose v Wilson [1907] - "If several flats in a block of buildings under one roof are used for the purpose of prostitution, the whole block may be a brothel." In that case 12 of the 18 rooms/flats were used by prostitutes who took men back.

Donovan v Gavin [1965] - Even separately let rooms may constitute a brothel if they are close enough together to create "a nest of prostitutes”.

Here in the UK, I often go to parlours where I pay a door fee in reception for the use of the room and then the girl takes me upstairs and I pay her in the room.

Those places in Hong Kong are just as much brothels as these establishments. If it looks like a duck, swims like a duck, and quacks like a duck, then......

Silverado,

I'm always impressed by your legal knowledge when it comes to punting. By the sounds of it you must have a few tomes of Punting Case Law in your legal library! ;)

Thanks silverado. Very good answer. There go my dreams of brothel ownership down the pan :P

The appropriate bird to use would be chicken (Chinese slang for lady of the night) as duck is Chinese slang for escorts of the male variety. Just a bit of trivia there.
