4 posts in this topic

The Appeal court recently quashed the conviction of the Doncaster Airport tweeter and now the CPS has been slapped down over consenting adults and private pictures.

I think one or two "sex industry" cases have not had quite the result Plod and the CPS expected.

That's too good a story not go without a comment. The behaviour of the jury makes me optimistic: and I hope the embarrassment to the CPS means they will better indentify cases to prosecute in the future.

Unfortunately am not a specialist ( did take a legal exam once but failed it ! )

A first instance acquittal is wonderful for the accused person, but it doesn't establish a precedent. CPS can simply blame a perverse jury, and find someone else to persecute. (...and, no, the Lady Chatterly trial, while it did appear to have a salutary effect on DPP, established no precedent.)

The extreme porn offence was always expected to be going to be difficult to prosecute, and that is borne out here, but....
