Hiya Guys

I was recently on a swinging site and saw a post which mentioned meeting etc and it provided a mobile number to call.

I phoned this number and said I saw it on fab****** and the woman hung up straight away. She then text back to say that my number was going to be reported to the police!! I text back saying that if I'd known it wasn't a genuine post online I wouldn't have call blah blah blah

I was wondering what are the consequences as it was a totally innocent action on my part(as innocent as it can be with the nature off it)

This is an important question which perhaps belongs on the Legalities and Legislation board as it is always possible that there will be maliciously placed profiles on any sex-related website and any of us could be caught like this.  Your post is clearly not discussing swinging which would be against the forum rules but raising an important general point that just happens to have arisen from your experience with a swinging site but I am nervous some mod will overinterpret the rules as an excuse to remove your post (it has happened before) and close off a discussion of interest to anyone involved in the pay-for-play scene.

As long as the discussion is kept to the legal consequences of phoning a number and does not widen out to a discussion of the swinging scene (plenty of other Forums where you can do that I'm sure) then I don't see a problem.

If you were to regularly ring the number, out of stupidity, or out of malice, I suppose this could, if plod & CPS had nothing better to do, be called "harassment", but a single call, even volunteering "fab******" cannot make anything.

 

I'd guess that the woman, who has given up swinging, or, indeed, taken over the flat from departed swingers, is getting, legitimately cross to receive these calls, and is trying to scare you, and others, off. If she does go to the police with a list of "perverts" telephone numbers, what will they do? Nothing, I'd say! I'd be very surprised if they'd clutter the crime intelligence section of the PNC with the numbers.

 

Far better for her to just get the number changed, I'd say, but, perhaps, she's just paid a bill for nice "change of address" cards to be printed, and doesn't want  to have to pay for "change of address (amendment)" cards as well!

If you phone a number you have found on a website, and say "Hi I found your number on fab*** ", all you have done is told the truth. You did find the number on a website, and you have merely stated that fact. No offence committed, I would say.

I agree that no offence is committed. If you read the previous posts you'll see that what I said was that the defence of "sorry wrong number mate" doesn't apply when the caller starts the call by saying (correctly) "I got your number off <porno/escort web-site>"!

Another reason to have a punting phone - you don't have to withhold the number and it's untraceable (provided you don't register it, which would be pretty silly).

My point being, what's the problem? If a complaint is made, what evidence is there he said that, or, indeed, said anything compromising?

Sounds like maybe somebody may have put a malicious profile up on the lady, had that done to me on a similar website, most annoying.   Don't worry about it, she'll take it down and you shouldn't get any flack.

Unless the police really want to find you and then they can pinpoint your location from data held by the phone companies.

 

In this case the lady will either contact the site and have her number removed, or if part of some malicious on going harassment then the police will be looking at the person who posted it.

And what could the police do really. You need to take a screen shot of the page you found the phone number on. Its not illegal to call a number in the public domain for sex is it. You didnt break any laws. Take the screen shot so that you have it as proof that you were not just dialling random numbers trying to be a sex pest but honestly. Woman calls up the police and complains that someone phoned her number for sex as he found it on a swinging site isnt going to get her very far as she cant prove what was actually said during the conversation although I would think she would give the pc who took the call a good giggle. 

 

Now if you have since repeatedly called the number or texted her continuously then you would possibly have an issue.

 

Sounds like possibly an ex boyfriend or pissed off jealous fellow swinger put her number up as revenge for some slight he feels he has recieved from her. If I were you the best thing you can do is just to email the website and explain what has happened. Hopefully they will take the number down and you can prove your a good guy should you ever have too...i doubt you would have too though x

Thanks guys, it's almost 48 hours since it happened so hopefully the authorities if they've been informed have seen it as the genuine mistake that it is
