Question about legalities of seeing someone under 18!

17 posts in this topic

Hello

Sasfan or someone could probably help me with this and I know there has been many threads/thoughts on the subject but I would like to know for difinate so I can reply to this query.

I have a young fella trying desperatly to book me, he says in his email he is 17 and I told him I would not see anyone under the age of 18 and he should wait, he came back telling me that under the sexual offences act 2003 it is an offence if he is under 16 but he is 17yrs and 9 month. (He is studying law aparently).

I am not thinking of seeing him in the slightest, but I was wondering exactly what the laws do say about this, is there a separate law of consent for buying adult services?

TIA

The age of consent in England, Scotland and Wales is 16, 17 in Northern Ireland, AFAIK the payment issue is irrelevant where age of consent is concerned. However to be on the safe side stick with 18 and over.

Knew you would come thru Sasfan, so really it is more of a moral issue, hard to argue with him as he is correct, I will just tell him that I am not confortable seeing someone so young!

Many thanks x

You should let him see you so you can make a man of him.

He must have blue balls at the moment. I bet he's saved every penny he's got. :D

It would be much better if he saw a class act for his first time with a WG. Otherwise he might not learn what a wonderful thing it is to punt, particularly when you have enough money to do so regularly with attractive and talented service providers. :)

Hi Ally

While I agree with you to an extent surely 17yrs 9 months is too young!! Well tis for me anyway! I have passed a couple of other girls numbers on to him, one is a new escort in York who is stunning and 19 or 20 depending on what site you see her on, however I have a feeling as he has another 'issue'. I think that he wanted a more mature lady as he will be embarassed with a younger one. And the other girl is the same age as me and very good at what she does, she might feel the same way as me I am not sure!

Funny that, I had exactly the same a couple of months ago, a 17 year old asking to book me and asked Sasfan via pm for exactly the same advice

I am like you Sabrina, would rather not see anybody that age, would not take the risks even though it does appear to be legal but secondly just way too young for me to feel comfortable about it.

If you go on holiday to for example Spain, and see someone who is 13, 14 or 15 while there,

you are breaking UK (but not Spanish) law and could, at least theoretically, be prosecuted when you return

Vernon Coaker (Parliamentary Under-Secretary, Home Office; Gedling, Labour) | Hansard source

Section 72 of the Criminal Justice and Immigration Act 2008 amends the extraterritorial provisions of Sexual Offences Act 2003 to remove the dual criminality requirement. This will allow the prosecution of UK nationals for offences committed against children overseas even if the act committed is not illegal in the country where it was committed.

For a girl to sell sex she must be 18 or you will be in trouble. I am not sure but id he is 18 you may still be in a tricky situation. I will ask a lawyer friend next time I see him what he thinks but I would not risk it. What if he was ward of court? May be some contempt?

That's what I was wondering. The age of consent is 16, but it's 18 if money changes hands. So a male paying a girl under 18 for sex is illegal. Presumably the law is the same for any paid sex transaction, even if the under 18 yr old is the one doing the paying?

SabrinaYork's question related specifically to the age of a potential customer, as did my answer. I made the assumption that SabrinaYork was over 18.

AFAIK there is no legislation regarding payment for sexual services.

The first time any legislation was written specifically targetting prostitution and age limits was in the 2003 sexual offences act. The law only refers to the prostitute being over 18. There is also legislation regarding teachers etc. sleeping with students, which also has a limit of 18. But I'm 100% certain that there's no legal barrier to a prostitute seeing a client aged 16/17. Nothing in the SOA 2003 refers to it, and certainly no legislation prior to that referred to it. So there's no legal issue.

I am amazed he didnt say he was over 18 even if he wasnt

You said he was training to be a lawyer if so he wont get far as a lawyer without bending the facts a bit

As always SASfan is spot on.

That was my understanding of the law, and therefore, as long as i could corroberate with ID the age of the prospective patron, (with the proviso of manners/etc) i have not had an issue with it.

I did not hear from this guy for about a while then I got this:

hi Sabrina,

i am enormously rependant that it told you a lie. actually i am 23, and can show my driving licence on arrival. i was really nervous and panicky to go on with this first time so i misrepresented as a 17 yr and thought to get some confidence and information doing this, so please don't take adverse inference of it.

is it okay now for me to go on? and in nutshell, is it still a big NO for intercourses(a levles)?

yours truly

Needless to say he did not get an answer from me!
