same new law other aspects

16 posts in this topic

This new law also has other parts one of which governs what is now illegal to download

seems if what you download is for sexual gratification purposes AND ALSO is one of(4 things)

show pain being inflicted

shows damage to genitals

is porngraphic

last one Ive forgotten

then you are breaking the Criminla justice act 2009 which is the same act as the new punting one

I am bemused on this as to what is illegal to download

as its all a matter of interpretation by magistrates etc as to what is causing damage

for example A could be seen as such so any picture with this in breaks the law

Now that site (we often refer to) has many pixs like that so are we now breaking law looking at that siteor downloading anything remotely like its content?

Does anyone here know this aspect of the new law and can maybe explain what is illegal

Thanks

just had a quick scan through the criminal justice act and I couldn't see what you're referring to. There was a section on child porn but nothing as you've described. There was a law passed a few years back regarding "extreme" porn, where the prohibition was on images which showed or appeared to show a person who is at risk of seriously physical harm. However that was a few years back, not last year.....

Not surprising that you couldn't find these clauses, as they formed part of the Criminal Justice & Immigration Bill 2009 & have been in effect for some time now.

just checked that bill (criminal justice and immigration ACT 2008) and it's the one I was referring to i.e the extreme porn one, which outlaws porn which shows a real or perceived risk of serious harm to genitals etc or to the life of the person and also outlaws animal porn.

So should I get rid of my old Penguin copy (translation) of The Golden Ass by Apuleius.

Not looked at it in years but I do remember there is a piece on training donkeys to rape women criminals in the Roman circus.

it was published before the Lady C trial so it was Ok then

I guess it depends whether it's illustrated or not!

Well, that was another piece of half-baked, knee-jerk legislation. It's been on the statute for just over a year now. Have their been any prosecutions? I'm not aware of any.

I vaguely recall a couple, although they were joint prosecutions with people who also had kiddy stuff, so they tagged on the donkey porn too. Haven't heard about any prosecutions solely for "extreme porn"
