Legalities of an escort answering service

I am new here as you can tell from the number of posts I have made, so hello one and all. I have been doing a little research around the internet and to be honest I have not got that far and so I thought I would drop this little poser in this forum.

My wife has a couple of friends who are 'independent escorts' who require and 'escort answering service' and they asked her whether she would be available for such activities on a pay per client basis. My wife is out of work so why not? Well here is why not... I know that independent escorting is legal and that escort agencies are a legal grey area. However an 'escort answering service' sounds a little too close to an escort agency to me. I wonder if anyone with any experience in this area can help me figure out the legalities of such a venture. If I cannot I will tell my wife to leave it well alone.

Without knowing the full facts there's a risk that she could be prosecuted for controlling prostitution for gain (section 53 SOA2003).

I think it's very unlikely but it does remain a possibility. The maximum penalty would be 7 years in Crown Court. I would have thought that a Community Order with possibly a Proceeds of Crime Act confiscation order would be the most likely sentence.

Realistically I can't see it happening though.

Have a look at the CPS Guidance notes in relation to Controlling. Some of the notes relating to Maids may be of use - although they relate to Brothel keeping.

Personally I wouldn't recommend it especially if your wife has her name on the deeds to your house.

I gave the link a once over. Thanks again for that. No she has not been asked to be a maid as it is not a brothel she is talking about. Purely acting as and answering service for her two friends who are independent escorts. They are both English born WGs who also have full time jobs. Additionally they are not persons who have been coerced into 'independent' escorting as it is their own choice. However my wifes friends feel that her spoken English is better than theirs and so could be of benefit to them to use her as an initial contact. This also frees her friends up from having to arrange it all.

As you say, she would not be a maid but the following may be relevant:

"The following models may provide a useful guide in assessing the involvement of the maid in assisting in the running of the brothel:

Minor Involvement: the maid is employed to just look after the woman or women supplying sexual services. She will keep the premises clean, buy provisions such as food and cleaning materials and ensure that items such as condoms, creams etc are available. She may receive calls from 'punters', provide the address to those wishing to attend and may answer the door. The maid will be paid by the woman or women on the basis of business. "

By analogy there may be an element of "control", albeit minor. You should bear this in mind.

Those would be the circumstances most relevant to the offer she was give. I think I will tell my wife to knock this offer on the head. Thanks for providing information/links and debating the necessary queries/points.

One last question. Could be an interesting one. Let me know if I should create a separate topic for this. My wife and I are going to move from the UK to another EU country at some stage within the next year. I can always set up a UK Skype landline number but host the answering service from a different EU country. I know laws on prostitution and associated activities vary between the different member states in the EU. Is there a punternet member that can advise on inter EU regulations on this sort of thing? I seriously do not expect an answer on this one and is probably a can of worms to debate.

Sorry about the last message as I had to finish as fast as poss and exit. I did register a little wobble as well but thought nothing of it. Bet safe than sorry. Looking at the news I see nothing about an earthquake <phew> and it is the last thing I need. We are back to the UK in two days and what with airport strikes enough is enough.

The control for gain law has been discussed many time on here. There was though a case in Hertfordshire, Silk and Lace, an agency who went to court and did not plead guilty. They were found Not Guilty.

As you say, controlled for gain has been discussed many times on the board.

The most authorative judicial decision is that given by the Court of Appeal in R v Massey [2007]. That dealt with a 29 year old girl and her boyfriend/pimp where the Court of Appeal confirmed his 4 year sentence.

So far as I am aware there are no properly reported decisions regarding escort agencies and section 53 SOA2003.

In the Silk & Lace case Steven Drew and his associates were found not guilty at Southwark Crown Court in 2007. They chose not to take the stand and give evidence, and were found not guilty by a jury of 9 women and 3 men.

Whilst it may have given the CPS something to think about it didn't really set any precedent. A different jury, a different judge and a different Court may well have led to a different result. Who knows ?
